Employee Relations (ER) involves work that is focused on supporting, promoting, and facilitating fair and productive employee/employer relationships. The role of ER involves working with the respective SMEs to review / create ER or ER related policies; providing guidance / advice on procedures and policies on matters related to ER or can give rise to ER implications (e.g. workplace conflicts, complaints, performance appraisal disputes, absence management, disciplinary actions/consequence management, exit management/business re-structuring); leading/managing internal investigations on complicated matters arising from PCC (personal conduct cases) and employee grievances or advising the HR Advisory team on management of the less complicated personal conduct and grievance cases; overseeing cases involving the Labour authorities/regulators; provide various reports on management information relating to PCC and grievance; analytics to identify trends and areas of significant people / HR risks

Responsibilities

  • Maintain high level of integrity & confidentiality at all times
  • Developing effective relationships with the business to promote good employee relations across HSBC
  • Manage internal investigations on matters arising from Personal Conduct Cases, employee grievances and complaints, whistleblowing and other workplace issues in line with HSBC protocols at a regional level and support as needed with cross border investigations across other regions.
  • Facilitate coaching for HR Advisory team and HR Consultants in areas of employee relations practices where necessary.
  • Support line management by providing advice and guidance on disciplinary, capability, grievance, and coaching managers where appropriate
  • Support in the provision of advice and guidance on business change, reorganization & restructuring activity including redundancies, insourcing, outsourcing employee terms and interpretation of policy
  • Providing advice and guidance on conduct considerations related to requests to rehire former employees
  • Providing advice and guidance on cases of dismissal/ termination of employment and liaising with Legal to ensure abiding with law.
  • Produce various reporting on ER matters/MI and analysis of regional trends e.g. HR Business Partner reports, Risk and Control Management Meeting reporting, Conduct queries, HSBCC bi-weekly reports, and Regulatory Compliance Oversight Committee on HSBC Confidential)
  • Support the Regional Head in terms of implementation and maintenance of Regional ER management information, analysis and reporting framework that supports and informs timely and effective business management and decision making at all levels.
  • Build and Maintain external and internal stakeholder relationships, Immigration, Labor office, Health Authority and other ER leads in other market sectors as well as HR generalist.
  • Support in creating, reviewing, refining employment policies and operating procedures and ensure they comply with Regional legal requirements and Group Function Instruction Manual (FIM). Embed policies and evaluate policy effectiveness
  • Being up-to-date with employment laws to ensure HSBC, management and employees are in compliance
  • Being up to-date about Employee Relations Framework and new ways of working changes.
  • Participate in HR/Group ER projects as required
  • Support the Senior ER role holder in MENAT in all ER aspects as and when required.
  • Manage Disputes raised through the UAE Ministry of Human Resources and Emiratization.
  • Execute the annual undertaking process applicable to Senior Positions in the UAE and escalate to management adverse findings potentially impacting fit & proper requirements applicable to Registered Individuals in line with relevant Standard Operating Procedures (SOPs).
  • Co-ordinate/lead with other HR risk stewards on gap analysis of any changes to employment law and regulation and create SOPs as required to ensure changes to internal policy are implemented.
  • Manage hearings under the bank’s disciplinary and grievance procedures, ensuring that decisions made comply with both internal and external spirit of the procedures to mitigate the risk of potential litigation and or cost impact. Provide support/advice on ER policy and practice to hearing managers (as applicable)
  • Be up to date with employment laws to ensure HSBC, management and employees comply.
  • Work in partnership with Employment Legal to provide guidance to key stakeholders on any employment related litigation. Ensure that all newly created and existing employment policies and procedures do anticipate and meet the legal requirements and market practice.
  • Regulatory reporting in the UAE i.e., Persona non-grata, work related injuries
  • Support work needed on ER owned risks and controls.

The jobholder, with guidance from Senior ER Manager will be able to interpret and apply HR policies and principles to complex people issues, supporting senior and executive managers accordingly:

  • Providing consistent, business focused employee relations advice and guidance to line managers in respect of complex ER issues and to members of the ER and broader HR teams.
  • Supporting on hearings under the bank’s disciplinary and grievance procedures
  • Supports business with decision making on complex investigations on discrimination, harassment and bullying, and working with the business in order to provide a sustained solution which meets business needs and is in line with country law and Banks policy to mitigate any potential risks.
  • Support on IR matters in MENAT region
Requirements

To be successful in the role, you should meet the following requirements:

Experience & Qualifications

  • Project management experience.
  • Graduate degree is a must to obtain UAE visa.
  • English – Excellent in both spoken and written. Written/Spoken Arabic will also be an advantage.
  • Experience with country law and labor relations within the UAE, and strong knowledge of Middle East culture
  • Proven ability to work well under pressure within demanding timescales.
  • Ability to exercise sound judgment and creativity in identifying options and risks to make the right decisions around issues that have a significant adverse effect on the organization.
  • Ability to write reports and minutes.
  • Ability to communicate effectively with people at all levels
  • Analysis and problem-solving skills
  • Interpersonal and communication skills, written and verbal.
  • Ability to assess risk and develop creative solutions to problems within the framework or bank procedures and country law
  • The ability to rapidly develop a detailed knowledge of ER practices and procedures
