Admission to the New York State Bar and a member in good standing with five (5) years post-admission trial and/or hearing experience before either courts of record or in administrative proceedings. Commitment to public service and good research/writing skills essential. Criminal litigation experience preferred but not required.

Supervising Attorneys assigned to the Administrative Litigation Unit perform the following functions, including but not limited to:

  • Supervise a team of 3-5 Assistant Counsels or other professional staff
  • Train and mentor Assistant Counsels and/or other professional staff consistent with established Unit policies, procedures and best practices; provide day-to-day direction on assignments and tasks
  • Manage assignment of cases to subordinate staff; track workload among team members; recommend and implement necessary adjustments to enhance productivity and quality of output
  • Review team work product for consistency with statute, agency legal positions, court decisions/legal precedent, and established Unit policies/procedures
  • Defend Justice Center determinations and legal positions in proceedings before Administrative Law Judges and appointed Arbitrators
  • Perform pre-hearing conferences and recommend proposed settlement terms to supervisor
  • Draft motions, decisions, opening/closing arguments, memoranda of law and briefs in support of agency determinations; prepare documentary evidence and witnesses for testimony at administrative and disciplinary proceedings
  • Consult with Justice Center investigators regarding allegations of abuse and neglect, and review associated evidence; identify gaps in existing evidence, and if necessary, recommend further evidence needed to determine whether an allegation of abuse and/or neglect should be substantiated
  • Draft, review, and edit Notices of Discipline (NODs)
  • Collaborate with and advise

State Oversight Agencies (SOAs) on employee discipline proceedings

  • Work collaboratively with other regional Supervising Assistant Counsels to identify operational issues, trends, and other factors impacting Unit operations; formulate and present improvement recommendations to Deputy for Administrative Litigation and the Assistant Deputy for Administrative Litigation, and other agency management
  • Participate in work groups or special project teams, as directed
  • Input and review all relevant case information in the Justice Center's Vulnerable Persons Central Registry (VPCR)
  • Conduct statewide training with Justice Center and SOA staff on relevant administrative litigation practices.
